Terms of Use

Preamble
These Terms of Use (hereinafter the "Terms") govern access to and use of the jefacturebien.fr platform (hereinafter the "Platform" or the "Service"), published by QR Communication SAS, registered with the Paris Trade and Companies Register under number 940 163 496, with its registered office at 23 rue de Richelieu, 75001 Paris, France.
Use of the Platform implies full and unreserved acceptance of these Terms.
Article 1 - Definitions
- Platform: the jefacturebien.fr website and all associated invoicing services
- User: any individual or legal entity accessing the Platform
- Account: the personal workspace created by the User to access the Services
- Services: the quoting and electronic invoicing services offered by the Platform (quotes, invoices, deposit invoices, balance invoices, credit notes, online payment, accounting exports)
- Plan: the subscription plan taken out by the User (Free, Standard, etc.)
Article 2 - Purpose
The purpose of these Terms is to define the conditions for accessing and using the jefacturebien.fr Platform, an online invoicing solution for freelancers, sole traders and very small businesses, which offers services for:
- Creating compliant quotes and electronic invoices (Factur-X)
- Issuing deposit invoices, balance invoices and credit notes
- Online payment of invoices (link and QR code)
- Accounting exports (FEC, CSV and major software formats)
Article 3 - Access to the Service
3.1 Access conditions
Access to the Services requires:
- Creation of a User Account
- Acceptance of these Terms and of the Terms of Sale
- Provision of accurate and complete information upon registration
- Verification of the business identity (KYB - Know Your Business)
3.2 Account creation
When creating an Account, the User undertakes to:
- Provide accurate, complete and up-to-date information
- Keep their login credentials confidential
- Immediately notify jefacturebien.fr of any unauthorized use of their Account
- Be responsible for all activity carried out from their Account
Article 4 - Description of the Services
4.1 Quotes and invoices
The Platform allows you to:
- Create and send quotes, then convert them into invoices
- Generate compliant electronic invoices (Factur-X), as well as deposit invoices, balance invoices and credit notes
- Validate invoice compliance against applicable standards
- Archive invoices in accordance with legal obligations (ISCA integrity)
4.2 Online payment
The Platform allows you to add an online payment method (link and QR code) to invoices via integrated payment providers.
4.3 Accounting exports
The Platform allows you to export entries and documents in FEC, CSV and major accounting software formats, for transmission to your accountant.
Article 5 - User obligations
The User undertakes to:
5.1 Lawful use
- Use the Service lawfully and in accordance with these Terms
- Not use the Service for illegal, fraudulent or public-policy-infringing purposes
- Not transmit unlawful or defamatory content, or content infringing third-party rights
5.2 Security
- Keep their login credentials confidential
- Not attempt to circumvent the Platform's security measures
- Not carry out denial-of-service or intrusion attacks
- Report any discovered security vulnerability
5.3 Compliance with Plan limits
- Comply with the issuance quotas of their Plan (number of invoices/credit notes per month)
- Not overload the Platform's infrastructure
- Use the Services within their intended purpose
5.4 Regulatory compliance
- Ensure that their use of the Services complies with applicable regulations
- Be responsible for the content of documents processed via the Platform
Article 6 - QR Communication obligations
QR Communication undertakes to:
- Provide a Service that complies with the announced technical standards
- Maintain Service availability (availability target of 99.5%)
- Secure data in accordance with best practices
- Inform Users of scheduled interruptions
- Process personal data in accordance with the GDPR
Article 7 - Intellectual property
7.1 QR Communication's rights
The Platform, its source code, design, documentation and all components are protected by copyright and remain the exclusive property of QR Communication SAS.
The User holds no ownership rights over the Platform. They are granted only a personal, non-exclusive and non-transferable right of use.
7.2 User's rights
The User retains full ownership of the documents they process via the Platform (invoices, contracts, etc.).
Article 8 - Personal data
The processing of personal data is described in our Privacy Policy, available at: https://jefacturebien.fr/confidentialite
The User acknowledges having read this policy before any use of the Service.
Article 9 - Liability
9.1 Limitation of liability
QR Communication undertakes to provide a quality Service but cannot guarantee:
- Continuous and uninterrupted availability of the Service
- The complete absence of bugs or errors
- Compatibility with all systems and browsers
9.2 Exclusion of liability
QR Communication may not be held liable for:
- Indirect or unforeseeable damages
- Data loss due to a User's fault
- Fraudulent use of the User's credentials
- The content of documents processed by the User
9.3 Liability cap
In any event, QR Communication's liability is limited to the amount of sums paid by the User over the last 12 months.
Article 10 - Suspension and termination
10.1 Suspension
QR Communication reserves the right to suspend access to the User's Account in the event of:
- Breach of these Terms
- Suspicious or fraudulent activity
- Non-payment
- Request from the competent authorities
10.2 Termination
The User may terminate their Account at any time from their client area. Termination results in:
- Removal of access to the Services at the end of the current subscription period
- Retention of data in accordance with legal obligations
- No refund for the period started (monthly subscription with no commitment, see Terms of Sale)
Article 11 - Amendment of the Terms
QR Communication reserves the right to amend these Terms at any time. Users will be informed of any substantial change by email or in-app notification.
Continued use of the Service after amendment constitutes acceptance of the new Terms.
Article 12 - Governing law and disputes
12.1 Governing law
These Terms are governed by French law.
12.2 Dispute resolution
In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing an amicable agreement within 30 days, the dispute will be submitted to the competent courts of Paris.

Article 14 - Miscellaneous
14.1 Entire agreement
These Terms constitute the entire agreement between the User and QR Communication regarding use of the Platform.
14.2 Severability
If any provision of these Terms is declared void or unenforceable, the remaining provisions shall remain in force.
14.3 Waiver
The failure of QR Communication to enforce any breach by the User of any provision of these Terms shall not be construed as a waiver of its right to enforce it subsequently.
Article 15 - International invoicing
15.1 Non-French parties
The Platform supports electronic invoicing involving non-French parties. The Factur-X format complies with the European standard EN 16931 and allows invoices to be issued and received in an international context.
15.2 Multi-jurisdictional compliance
The User remains responsible for the compliance of their invoices with the tax and accounting regulations applicable in the relevant jurisdictions. jefacturebien.fr provides the technical tools for generation and validation but does not replace the User's legal or tax advice.
15.3 Intra-EU VAT
For intra-EU transactions, the Platform allows the inclusion of mandatory mentions (intra-EU VAT numbers, reverse-charge mentions) in accordance with Directive 2006/112/EC.
